These Terms govern your use of the SmarterAds Studio website, free Marketing Leak Test, paid deliverables, and related services.
Agreement to these Terms
By accessing the website, submitting a form, purchasing a service, or using a deliverable, you agree to these Terms and the linked Privacy, Refund and Delivery, and AI Disclosure policies. If you do not agree, please do not use the services.
Services
SmarterAds Studio provides marketing diagnostics, strategic analysis, educational materials, personalized Snapshots, Roadmaps, and related consulting or implementation support. The scope, price, and estimated delivery timing shown at purchase form part of your service agreement.
Your responsibilities
You agree to provide information that is accurate to the best of your knowledge, respond to reasonable clarification requests, and use the services lawfully. You confirm that you have the right to provide the business information you submit. Do not submit confidential information belonging to another person or business without authorization.
Strategy, judgment, and results
SmarterAds Studio provides analysis, recommendations, and educational guidance. Business and marketing outcomes depend on many factors outside our control, including market conditions, implementation, budgets, platforms, competition, and customer behavior. We do not guarantee revenue, sales, leads, rankings, advertising performance, or any particular outcome.
AI-assisted analysis
You understand that SmarterAds Studio may use AI-assisted tools and automation to analyze responses, support research, identify patterns, and prepare draft deliverables. Paid work receives human review. Additional details appear in our AI-Assisted Analysis Disclosure.
Payment, cancellations, and delivery
Prices are shown in U.S. dollars unless stated otherwise. Payments are processed by third-party providers. Personalized services become nonrefundable after the completed intake is submitted and work begins. Delivery timing and cancellation details appear in our Refund and Delivery Policy.
Intellectual property
The SmarterAds Studio name, Attention-to-Revenue Framework, website copy, processes, templates, graphics, and educational materials are owned by SmarterAds Studio or used with permission. Your purchased deliverable may be used internally for your own business. You may not resell, publish, reproduce, distribute, or create competing products from our proprietary materials without written permission.
Your business information
You retain ownership of the information and materials you submit. You grant SmarterAds Studio permission to use them only as reasonably necessary to provide, improve, secure, and document the services. We will not publicly identify your business as a client or publish a case study without permission.
Third-party services and links
The customer journey may use third-party services such as Kit, Tally, Stripe, Make, AI providers, and hosting services. Their availability and conduct are outside our control and governed by their own terms. Links to outside resources are provided for convenience and do not constitute an endorsement.
Limitation of liability
To the fullest extent permitted by law, SmarterAds Studio will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from the website, services, recommendations, third-party platforms, or implementation decisions. Our total liability for a paid service will not exceed the amount you paid SmarterAds Studio for the service giving rise to the claim.
Governing law and changes
These Terms are governed by the laws of North Carolina, without regard to conflict-of-law principles. We may update these Terms as the services evolve. The effective date above identifies the current version.
